City of Gainesville Depot Park: MCB Oil Company (Alachua County, FL)

Mr. Brigham, while a partner with his predecessor firm Brigham Moore, LLP, represented MCB Oil Company (Don McBride) which had a wholesale/retail gasoline station within walking distance of downtown Gainesville together with other land held for investment.

The City of Gainesville filed condemnation proceedings to whole take MCB Oil Company’s property for Depot Park.  The park garnished much local publicity as it featured the relocation of a historic train depot combined with a stormwater pond needed for both water quality and quantity control.

The City sought to acquire the property at a price reflecting a depressed industrial market.  At trial, the owner put on evidence to show the trends in use and value in the neighborhood which favored redevelopment.  Mr. McBride testified as to how his investment expectations were being cut short by eminent domain.  To support his testimony, Mr. Brigham prepared exhibits to show examples of both public and private investment in the neighborhood.  These exhibits showed a much different picture of the neighborhood, proximate to the new Alachua County Courthouse, than a depressed industrial market.  The City’s initial offer was $224,000.  The jury verdict was $917,500.
