FDOT Wekiva Parkway: Family-Owned Landscape Nursery and Garden Center (Seminole County, FL)
In 2017, Brigham Property Rights Law Firm represented a family-owned, landscape nursery located on State Road 46 in Seminole County, Florida. The owners opened their landscape nursery business five years before the taking and were entitled to statutory business damages in addition to full compensation for a partial taking of their real property. FDOT was converting State Road 46 to a limited access toll road with directional frontage roads as part of its portion of the Wekiva Parkway Project. FDOT’s initial offer of full compensation for the real property was in the amount of $1,153,700. After FDOT filed its eminent domain lawsuit, Brigham Property Rights Law Firm negotiated a settlement which totaled $4,000,000 for both statutory business damages and full compensation for real property.
